THE FOOTBALL ASSOCIATION/LEAGUES

Many people involved in soccer at local level are confused as to the different roles of the FA and leagues. These brief notes represent an attempt to show that difference.

The Football Association Ltd. is the Governing Body of football in England. To exercise the control and direction of the game locally, the Association delegates much of its work to County Associations, each responsible for a defined geographical area. In turn, some of the larger Counties, such as Cheshire, further delegate some functions to Districts of which Chester & District is one.

The F.A. is responsible for the implementation of the Laws of the game many of which these days are subject to International Board decisions (F.I.F.A). The Association is also responsible for the affiliation of leagues, Competitions and Clubs, each of which must satisfy the F.A. as to its fitness.

    1. By producing rules which include the right of appeal to the decisions against the application of those rules
    2. By producing an annual statement of accounts and
    3. By their Management arrangements

Each year before the season commences, Leagues Competitions and Clubs must complete Form A before they are affiliated to play the game. In addition, Leagues must submit their rules and a balance sheet for sanction before each season. Nationally the F.A. is responsible for the regulations governing contracts between professional players and their clubs.

The F.A. is responsible, through regulations for the registration and control of referees and for the discipline of Leagues, Clubs and Players. Everyone involved in soccer should obtain and read the F.A. publication “REFEREES” CHART AND PLAYERS GUIDE TO THE LAWS OF ASSOCIATION FOOTBALL” which is revised regularly. At every organised game of Football, the F.A. is represented by the referee whose task is to ensure that the game is played in accordance with the laws.

Turning to the role of the Leagues, their aim is to organise the playing of the game between affiliated teams, which apply, for annual membership.

Each League operates within rules sanctioned by the F.A. and is responsible for registering players with Clubs. Clubs must keep records of all their players, and of the games they play in.

The F.A. organises its own cup competitions, as well as having the power to sanction competitions run by leagues and other bodies.

In summary, Leagues organise the playing of the game in accordance, with the laws, rules and regulations prescribed and controlled by the Football Association.

  1. CONSTITUTION
    1. This Association shall be called The Chester & District Football Association and shall be affiliated to and directly under the control of The Cheshire County Football Association Limited. Members shall consist of such Clubs and Sanctioned Leagues playing Association Football within an area as defined by The Cheshire County Football Association Limited. Herein after they shall be referred to as members.
    2. All clubs should be affiliated to The Cheshire County Football Association Limited and shall satisfy the District Association Council that they are properly constituted and playing Association Football in accordance with the Rules of the Football Association.
  2. AFFILIATIONS
    1. The Annual affiliation fee for each member Club and Sanctioned League shall be determined from time to time by the Council of The Cheshire County Football Association Limited. They shall permit the affiliation at a reduced fee of Minor Clubs (under 18 years of age on 1st August of the current season) and Clubs competing in Charity, Workshop or Small Side competitions, but such affiliations shall not carry any voting power.
    2. The annual affiliation fee accompanied by Form A must reach The Cheshire County Football Association Limited by the 30th of June in each year. Failure to comply with this rule will result in a fine of £10.00.
    3. Clubs paying for membership for the first time shall complete Form A and submit the affiliation fee upon application.
    4. Workshop, Charity and Small Side competitions and the Clubs competing therein shall be affiliated at a separate fee as determined by The Cheshire County Football Association Limited.
  3. MANAGEMENT
    1. This Association shall be governed, and its affairs are managed by a Council consisting of the following Officers and representatives. In the case of non-attendance, no member can be represented by a deputy.
    2. The Officers of the Association shall be:
      1. a) President
      2. b) Four Vice Presidents
      3. c) Life Members
      4. d) Honorary Treasurer
      5. e) Honorary Secretary
      6. f) Honorary Referees Secretary
    3. At the discretion of the Council, the following Officers may be elected:
      1. a) Honorary Assistant Secretary
      2. b) Honorary Competition Secretary
      3. c) Honorary Youth Secretary
      4. d) Honorary Assistant Referees Secretary
      5. e) Honorary Referees Development Officer
    4. The representatives of the Council of this Association shall be:
      1. a) Eight Area Representatives
      2. b) One representative from each league sanctioned by the Cheshire County F.A.
      3. c) One representative of the District Schools F.A.
      4. d) One representative from each Club being a member of the Football League, The Football Conference, Northern Premier League and North West Counties FL
    5. The Divisional Representative of The Cheshire County Football Association Limited shall be a member of the Council of this Association.
    6. Nine members of the Council shall form a quorum for the transaction of business.
    7. The following shall be elected at the Annual General Meeting
      1. a) The Officers in 3.2 and 3.3 (where appropriate) except for the Four Vice Presidents, and Life Members.
      2. b) The Area Representative shown in 3.4 (a)
    8. The Four Vice Presidents shall be elected from within the Council by the Council at the April or May meeting and such persons so elected shall serve as Vice Presidents from the date of the next Annual General Meeting until the following Annual General Meeting.
    9. The representative shown in 3.4(b) (c) and (d) shall be notified to the Secretary of this Association not later than the 30th of July. In the event of a vacancy occurring the name of the substitute representatives shall be notified as soon as possible.
    10. At the first meeting of the Council after the Annual General Meeting the Chairman and Vice Chairman shall be elected.
    11. In the case of an equality of votes on any matter, the Chairman for the time being shall have a second casting vote.
    12. The Council shall have power to fill any vacancy, which may arise, as and when required, apart from the President and those representatives referred to under rules 3.4(b), (c) and (d).
    13. There shall be an Emergency Committee elected by the Council with plenary power. Three members to form a quorum.
    14. The Council shall manage all affairs of the Association and their decisions shall be final, subject to the right of appeal to The Cheshire County Football Association Limited. They shall have the authority to create such sub-committees of a permanent or temporary nature as they consider necessary and have power to delegate such of its powers as it may decide to any such committee.

      The Council shall have the power to co-opt (with or without voting power as it shall decide), to any of its sub-committees.
    15. The Council shall elect a Referee Committee at whose meetings five shall form a quorum. The Committee shall have control of all referee matters (subject to The Cheshire County Football Association Limited Regulations for the Government of Referees) and make all appointments. The proceedings shall be subject to confirmation by the Council.
    16. The Chairman of the Council and Honorary Secretary shall be an ex-officio member of all committees.
  4. GENERAL MEETINGS AND NOMINATIONS
    1. The Annual General Meeting of this Association shall be held prior to the 1st of July in each year at such a time, as the Council shall determine.
      1. a) The Annual General Meeting of this Association shall be held before 1 July in each year at such time and place as the Council determine.
      2. b) The Secretary shall, no later than 30th April in each year, convene a meeting of the Council when the date of the Annual General Meeting and the closing date for nominations shall be fixed
      3. c) The Secretary shall, at least 28 days before the date fixed for the Annual General Meeting, send a nomination form for each member.
      4. d) Those desiring to nominate a candidate must return the nomination form, duly completed, to the Secretary on or before the closing date. Such nominations shall be signed by the Chairman and Secretary of the member.
      5. e) Only those members who have paid their affiliation fee by 1st May for the ensuing may nominate.
      6. f) Each member Club and sanctioned League can only nominate one candidate for each office and one Area Representative.
      7. g) The Chairman of the Meeting shall decide on the validity of all nominations made to the meeting and his decision as to the results of all voting and every other matter, thereat shall be final. An entry in the Minute Book signed by the Chairman of the Meeting, shall be conclusive evidence of the terms of every resolution and every other decision taken.
    2. An Extraordinary General Meeting may be called at any time to the Council, or upon a requisition to the Secretary signed by ten members entitled to attend and vote at a General Meeting, indicating the purpose thereof
    3. The Secretary shall subsequently give 14 days’ notice to all members of this Association of the place, and the date of such Annual or Extraordinary General Meeting together with an agenda specifying the nature of all business to be transacted at the meeting.
    4. Each member shall be entitled to send one representative to any General Meeting, but no two members shall be represented by the same individual.
    5. The President of this Association shall act as Chairman at all General Meetings (and in his absence his deputy shall be decided by the other Officers present at the commencement of the meeting in question).
    6. The voting at Annual or Extraordinary General Meetings of this Association shall be by ballot unless a show of hands is agreed by a majority of those entitled to vote.
    7. Members are entitled to vote at the Annual General Meeting only if their affiliation for the ensuing season has been paid by such dates as has been decided and advised by the Council.
    8. An Officer of the Association cannot represent a member Club or Sanctioned League. The Officers and Council members shall be ex-officio and entitled to attend and vote at all Annual and Extraordinary General Meetings.
  5. MANAGEMENT OF COMPETITIONS AND CLUBS
    1. Each club shall be required to keep an account book showing full details of income and expenditure. The council shall have powers at any time to inspect the books and papers of all clubs affiliated to this Association. All vouchers and documents relating thereof must be produced on demand.
    2. All Open Age clubs affiliated to this Association and playing in sanctioned leagues shall enter a Cup Competition of the Association. The Council of the Association shall have the power to control, conduct and manage its own approved competitions and determine which competition a club shall enter.
    3. Any club may enter the competition of another District Association provided they have honoured their obligation to and with the permission of this Association.
    4. Clubs and players shall not compete in any match or competition (including small side matches or competitions) the proceeds of which are not devoted to a sanctioned football club, Football Association or some other object approved by the Association.
    5. Six a side and similar competitions are forbidden unless sanctioned by The Cheshire County Football Association Limited. Competitions being completed within a period of 24 hours shall be permitted to register at an all-embracing fee, including the clubs, as determined by The Cheshire County Football Association Limited. All other competitions to be registered in accordance with rule 2.
    6. The playing season shall be defined from time to time by The Football Association.
    7. Clubs, players, and officials subject to the jurisdiction of this Association shall not be associated with or play with or against any which is not a member of this Association or some other recognised affiliated Association.
    8. No match between unaffiliated teams shall be played on grounds, which are under the jurisdiction of clubs who are members of this Association.
    9. This Association shall have first claim upon all grounds and players belonging to clubs who are members of this Association. Clubs, players, or members of clubs violating this rule shall be dealt with as The Cheshire County Football Association Limited shall decide.
    10. Every club is responsible for the action of its players, officials, and spectators in accordance with the regulations issued and amended from time to time by the Football Association and The Cheshire County Football Association Limited.
    11. The Officials of any Club, League or Competition, which may disband, shall produce all papers, books and vouchers and an audited statement of accounts showing the financial position at the date of disbandment. The consent of The Cheshire County Football Association Limited must be obtained before any assets are disposed of.
    12. Any member Club, League or Competition changing its Secretary or any registered Secretary changing his address must advise the secretary of this Association within seven days thereof. Failure to comply will result in a fine not exceeding £10.00. The registered Secretary of a member or organisation is the only official recognised by this Association for the purpose of all correspondence.
    13. Unless instructed otherwise, all correspondence on matters concerning this Association, shall be addressed to the Honorary Secretary.
  6. STATUS OF PLAYERS
    1. The status of players is as defined from time to time by The Football Association.
  7. TRUSTEES AND FUNDS ASSOCIATION
    1. The President, Treasurer and Secretary for the time being of this Association shall be Trustees and the legal holders and authorised signatories of all monies and properties belonging to this Association, including competition trophies.
    2. All monies received by the Association shall, in the first instance, be lodged in an Account with one of the Joint Stock Bank or a Building Society.
    3. All payments by this Association shall be by cheques issued on such banking account and shall bear the signatures of two such trustees.
    4. So much of the funds of this Association as may not be required for immediate use or to meet the usual accruing liabilities shall be invested with the authority of the Council.
    5. The Statement of Accounts of this Association prepared by the Treasurer up to 30 June and duly certified by appointed Auditors, shall be presented to the Annual General Meeting.
    6. An Officer or Member of the Council who shall certify the correctness of the same shall check all statements of gate receipts in which this association is concerned.
  8. REFEREES
    1. 8.1 All referees shall be registered annually in accordance with the regulations for the Government of Referees of The Cheshire County Football Association Limited.
  9. LONG SERVICE
    1. Any Officer of this Association or member of the Council who has completed 21 years in the service of this Association shall be presented with a Long Service Award at the Annual General Meeting following completion of such period.
    2. The Council shall have the power to elect Life Members who shall not be debarred from holding any other office in this Association. (N.B. Where District Football Associations have existing Life Vice Presidents, they may remain in office, but no such further appointments shall be made).
  10. PROTESTS AND APPEALS
    1. Any protest made by a club under these Rules shall be in writing and duplicate copies shall be sent to the Secretary of this Association accompanied by a deposit of £25.00, which deposit may be forfeited if the protest is not sustained. In the case of a frivolous or vexatious protest being made, the Council shall have the power to order the protesting Club to pay such expenses as may be decided
    2. Should any Club concerned in a protest have a member on the Council, that member shall not be eligible to sit on the Council whilst the protest is being discussed.
    3. A member may within seven days of receipt by them of written notification of any decision made in accordance with these Rules, appeal against such decision by lodging particulars in duplicate, accompanied by a fee of £35.00 to the Secretary of The Cheshire County Football Association Limited for the adjudication of the Board of Appeal whose decision shall be final and binding on all concerned.

      In the event of the appeal being unsuccessful, the fee shall be forfeited or returned to the member in whole or in part at the discretion of the Board of Appeal, who shall decide by whom the costs of the appeal shall be borne.

      A copy of the appeal must be sent to The District Association Secretary and the operation of the decision made by the Association shall not be suspended pending the result of the appeal unless the Board of Appeal or the Council of The Cheshire County Football Association Limited through its Officers orders such suspension.
  11. GENERAL PROVISIONS
    1. No club may change its name without the permission of The Cheshire County Football Association Limited and such permission will not normally be given after 1st August, of the current season.
    2. The Council shall have full power to deal with any matter not provided for in the rules, subject to the rules of The Cheshire County Football Association Limited.
    3. The Secretary of a League, Club or Competition shall be the nominated person to receive and answer all correspondence with the association. any participant, league, club, or competition failing to answer correspondence, or implement an instruction of the association within the time indicated, shall be liable to a minimum fine of £25. in the event of the participant, league, club, or competition then failing to answer the correspondence, implement the instruction, or pay the fine by the specified date, the participant, league, club, or competition will be liable to a charge of misconduct by the Cheshire County Football Association.
  12. ALTERATIONS OF RULES
    1. In the event of any alterations being considered necessary to the Rules of the Association, notice of the proposed alteration must be sent in writing to the Secretary of this Association who shall forward it to the Secretary of The Cheshire County Football Association Limited for consideration by that body and by all District Associations. Any alterations confirmed as above shall be adopted by all District Associations.
